These are the General Terms and Conditions of profitrip GmbH, Goerzallee 311, 14167 Berlin.
profitrip GmbH (hereinafter: "MrGrand") operates a system for booking travel services at www.mrgrand.com (hereinafter: "online portal" or "portal"), primarily aimed at business travelers. Registered users of the portal who have been activated (hereinafter: "user") can request and book travel services through the portal (e.g. hotel stays) offered by various providers. In this case MrGrand acts as an agent.
The General Terms and Conditions apply to any use of the online portal. Differing, conflicting or supplementary terms and conditions do not become a part unless their applicability was expressly approved.
Registration is required to become a user of the online portal. Registration and activation are free of charge. Users are neither entitled to activation nor to permanent use following activation. Only persons legally competent and of full age may become users. Upon request, users must submit a copy of their personal identification card or their passport to MrGrand.
Registration requires completing the registration form provided at www.mrgrand.com and submitting it to MrGrand electronically. Every user must provide the information required for registration truthfully and in its entirety. Following successful registration and activation, the user receives a confirmation from MrGrand via e-mail.
The user agrees to promptly update any information as it changes. Any changes may be made online after signing into "Account". The user agrees to keep his password confidential. Use of the online portal may be terminated at any time and without a term of notice via e-mail to service@mrgrand.com.
Each user may only register for the portal once and by registering acknowledges he is not yet a registered user or that a prior account has been deleted. Simultaneously registering several user accounts is not permitted. Circumventing this stipulation, particularly by using other and/or incorrect information or e-mail addresses is not permitted. Users with incomplete, questionable information in their profile, enquiries or bookings may be banned from or declined use of the online portal. The same applies to users who have attracted the attention of travel services or MrGrand for unpaid or partially unpaid invoices. Use of the online portal is non-transferable.
MrGrand provides users of the online portal with a system for booking third party travel services. Information provided by the user whilst searching (such as city, period, amenities, etc.) will be included by MrGrand as best possible. MrGrand reserves the right to limit the travel periods specified by the user in the search. The user is not obligated to book. MrGrand cannot guarantee the availability of travel offers.
MrGrand is not the provider and contracting party of the travel service. MrGrand is merely an agent. The contractual relationship with MrGrand is not subject to travel contract law (§§ 651a ff. of the German Civil Code).
The user agrees to maintain confidentiality over information about travel services (particularly prices, terms and features) obtained through the online portal. Publication or otherwise providing access to third parties will result in being banned from the online portal. In this event MrGrand reserves the right to assert other claims (e.g. indemnity).
As an agent, MrGrand merely forwards information provided by the user to potential providers. Bookings are made by the user directly by selecting and confirming an offer displayed in the portal by MrGrand. A booking refers to the user's offer to accept or procure services or products described in the online portal. The booking confirmation may be viewed and printed through the portal. In addition, a booking confirmation is sent to the e-mail address specified by the user. When paid immediately (see 5.), MrGrand will e-mail the user a respective voucher (e.g. hotel voucher). The user must notify MrGrand if he did not receive the booking confirmation or the required voucher or the documents contain incorrect information with respect to the user information (e.g. name, address). By booking and sending the booking confirmation the booking becomes binding for both the user and the provider. On immediate payment, the booking only becomes binding once the voucher has been sent. Fulfilment of the agreement for travel services is solely between the user and the service provider. In this respect, general terms and conditions of the providers apply. The sole contracting party to the provider is the user whose account was used for booking.
Complaints regarding travel services must be reported to the provider directly with proof, during travel, promptly after the deficit occurs. The user must document deficits accordingly (e.g. pictures). MrGrand must be informed of the complaint in writing at the same time.
A user is not permitted to book more than five rooms at the same time through MrGrand for the same or a slightly different period. In the event MrGrand determines a user reserved more than five rooms total through separate bookings, MrGrand may cancel the bookings and assess cancelation fees. In the event the prohibited bookings are not identified prior to commencement of service, the service provider may demand a different (typically higher) hotel rate from the user. If a user wishes to book more than five rooms, he may contact MrGrand via e-mail.
Transfer or resale of travel services booked through the online portal is not permitted. The same applies to the assignment or sale or claims against providers of travel services. Any speculative booking of fraudulent intent or abuse of obviously incorrect pricing is prohibited resp. void.
The user is obligated to provide a valid credit card during booking. The credit card information provided will be verified and transmitted to the provider of the travel service, if necessary, to ensure payment for the travel service. The provider of the travel service is permitted to charge the cancelation fees accrued at the time to verify the credit card is valid or guarantee the booking. Upon utilising the travel service, the provider will bill the travel service on site. MrGrand is furthermore authorized to accept payments for the service providers. In this case the user will be notified upon booking, that payment for the travel services will be processed directly by MrGrand. MrGrand reserves the right to charge the user for any chargeback costs for credit card payments when caused by the user. The prices specified on the website are final prices offered by the provider including taxes and fees. Final prices for hotel bookings may be subject to tourism dues, visitor's taxes or so-called resort fees payable at the hotel. Due to continuously changing conditions MrGrand will not inform of these dues separately.
Please note, when booking hotels, value added tax will not be itemized on the invoice. By booking, the user waives the itemization of tax.
The user's booking is binding until canceled by the user. The provider of the travel service will list the cancelation terms in the offer. By booking, the user agrees to the cancelation terms of the service provider. Depending on the provider, the user may be obligated to pay the agreed price in full or in part if the booking is not canceled in a timely manner. Partial payment will only apply when specified at the time of booking. The same applies to travel services not utilised without canceling.
Cancelations should be made through the online portal. When canceled directly through the provider, MrGrand will be unable to provide information regarding the time of cancelation. Any booking paid through MrGrand must be canceled solely through MrGrand.
In the event the user departs earlier than booked, the travel provider is entitled to demand compensation for the loss incurred due to the days not utilised.
Hotels are classified based on self-assessment of the respective hotel operator according to the common international or national categories, which are indicative of the hotel amenities without obligation. The information provided regarding category, room facilities, hotel amenities and service are based on the information provided by the hotel operator. MrGrand does not verify this information and assumes no liability for their completeness or correctness.

All MrGrand data material is copyrighted. Duplication, adoption, use, sale or the commercial use of data material are not permitted and require the written consent of MrGrand. The portal may only be used for individual enquiries. Automated use of the portal is not permitted.
MrGrand is only liable for wilful intent and gross negligence. Insofar as reasonable violation of obligations is based on simple negligence and a material contractual obligation has been wilfully violated, the MrGrand liability for indemnity is limited to the foreseeable damage that typically occurs in comparable cases. In the event of homicide, injury to health or body, MrGrand is liable in accordance with the law.
All information was gathered with the utmost care. However, MrGrand cannot assume any liability for errors during data collection or data transmission. Error-free data communication over the Internet that is available at all times cannot be guaranteed at the current state of technology. In this respect MrGrand is not liable for continuous and uninterrupted availability of the online portal, nor for successful e-mail delivery.
The agreement is subject to the laws of the Federal Republic of Germany. The original German version of these terms and conditions have been translated into English. The translated version is a courtesy and office translation only and the user cannot derive any rights from the translated version. In the event of a dispute about the contents or interpretation of these terms and conditions or inconsistency or discrepancy between the German version and this English version of these terms and conditions, the German language version to the extent permitted by law shall apply, prevail and be conclusive. The German version is available here or shall be sent to the user upon written request.
If the user is a merchant, the sole jurisdiction for all disputes arising directly or indirectly from the contractual relationship is the place of business of MrGrand. The same applies if the user does not have a general place of jurisdiction within the country or moves his usual place of residence abroad or his domicile or usual place of residence is unknown at the time legal action is filed.
The agreed place of fulfilment is Hennigsdorf, Germany.
MrGrand assumes no warranty for the contents of third party websites, including when linking these websites. The respective provider or operator of the linked sites shall always be responsible for the contents of such sites. The linked sites were checked for statutory violations at the time of linking. No unlawful contents were detected at the time of linking. Continuous review of linked websites is not reasonable. Links will be removed immediately upon MrGrand learning of violations of the law.
In the event individual provisions of these terms and conditions are or become unlawful, this does not affect the validity of the remaining provisions. The omitted or invalid provisions will be replaced by the respective provisions of the law.
